To benefit from the exceptional prices reserved for professionals, you must provide the following supporting documents with your first order (SIRET number, or a photocopy of your diploma and identity card).
Please note that your order will only become effective once your professional account has been validated by our services. Indeed, a post-validation will be carried out for any new order created by a non-existent professional account.
Gouiran reserves the right to put on hold or cancel any order that does not present the required or fraudulent supporting documents.
The validation period for a professional account can vary from 48 hours to 5 working days.
In the event of a linked order cancellation, Gouiran undertakes to fully refund the payment within 5 working days.
Prices
Prices on the website are indicated in euros excluding taxes. They do not include the VAT applicable on the day of the order. Any change in the applicable rate may be passed on to product prices. After this date, they are subject to change at any time. The prices mentioned in the catalogs are prices for professional buyers (buyers with a valid SIRET number and an activity related to hairdressing or aesthetics. Under no circumstances can a private buyer claim to benefit from the indicated prices).
Stock
SAS Gouiran undertakes to fulfill received orders only within the limits of available product stock and the availability of personnel required for various services, if applicable. In the event of unavailability, SAS Gouiran undertakes to inform the buyer as quickly as possible.
Payment terms
The buyer must pay for their order by bank check, credit card or bank transfer, either in full or in 3 interest-free installments. For payment in 3 installments, Gouiran offers a simple and quick payment facility that allows you to pay in three monthly installments, up to a limit of €3000 per order, while enjoying your product immediately.
Gouiran retains ownership of the products subject to the order until full payment of your order price.
Failure to pay an installment when due will result in the immediate demanding of all outstanding amounts plus unpaid fees. Should the buyer present a financial risk, SAS GOUIRAN may, without any explanation, withdraw from the order and/or modify the payment method.
In all cases, repeated payment delays will oblige the seller to make deliveries against immediate payment by check or cash. Extensions of payment deadlines can only be granted in exceptional circumstances and will incur interest charges based on 4 times the legal interest rate for the current year, as well as reimbursement of any costs incurred by the seller.
In addition, a flat recovery fee of €40 will be due.
Late penalties
In accordance with the provisions of Article L-441-6 of the Commercial Code, late payment penalties at an annual rate of 20% and a compensation of €40 will be due in the event of non-payment on the day following the payment deadline stated on the invoice.

Warranties
The warranties offered on the equipment sold are identical to those offered by the manufacturer.
Excluded from the warranty are the cleaning and routine maintenance of the equipment as defined in the user manuals as being the responsibility of the buyer, as well as the supply of products necessary for these operations.
The buyer will lose the benefit of legal and conventional warranties, particularly in the event of:
- abnormal or abusive use of the equipment;
- repairs or any interventions carried out by persons other than the seller or not approved by him or the manufacturer, or if these interventions did not comply with the instructions;
- water damage or damage to the equipment resulting notably from collision, falling materials, chemical aggression, fire, vandalism or malicious acts;
- deterioration or accidents resulting from an error in handling or a lack of supervision or maintenance;
- premature deterioration due to wear or anomalies not reported to the seller in time;
- the buyer's refusal to allow the seller access to the equipment for maintenance, inspection or repair operations.
The seller may suspend legal and conventional warranties in case of delayed or partial or total non-payment of the equipment price.
The seller's liability is limited to the repair or replacement of equipment found to be defective or having a manufacturing, labeling or packaging defect. The seller's services will have the possibility to investigate the alleged defects. All other express or implied warranties are excluded. No liability will be accepted for direct or indirect losses or damages, whatever the cause.
Retention of title
In application of Law no. 80.335 of 12/05/80, goods and materials and their accessories remain the property of the seller until full payment of the invoiced price. The buyer is prohibited from reselling or transforming the sold goods until they have fully paid the price. In the event of judicial settlement or liquidation of the buyer's assets, the seller reserves the right to prohibit any use of unpaid goods remaining in stock. This clause also applies to goods entrusted to the seller for maintenance, renovation or transformation operations, particularly in the context of After-Sales Service operations.
In cases where equipment is withheld for non-payment of the after-sales service invoice, storage fees for the equipment may be charged in addition to late payment increases. These fees are calculated based on the cubic volume of the stored equipment, €45 excluding tax per cubic meter per month, the cubic volume used being that required for potential transport of this equipment by van.
Delivery
By derogation from Article 1583 of the Civil Code, the delivery of materials and goods transfers the risks to the buyer, both for damages suffered and those caused to third parties. The return of the equipment will be at the expense and risk of the buyer.
Entire General Terms and Conditions of Sale
Should any clause of this contract be rendered null and void by a change in legislation, regulation, or by a court decision, this shall in no way affect the validity and observance of these general terms and conditions of sale.
Duration
These general terms and conditions of sale apply for the entire duration of the availability of services and products offered by SAS GOUIRAN.
Proof
Computerized records, kept in the computer systems of SAS GOUIRAN and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
Applicable Law and Jurisdiction
These general terms and conditions of sale are subject to French law. In the event of a dispute, and in the absence of an amicable agreement between the parties, jurisdiction is granted to the competent courts of Montpellier, notwithstanding multiple defendants and/or third-party claims, even for proceedings.
